Anayasa referandumlarının demokratik meşruiyet kriterleri: Türkiye ve Şili deneyimleri

Özet: Günümüz demokrasilerinde referandum, bir siyasi katılım aracı olarak gittikçe daha da fazla başvurulan bir yöntem haline gelmiştir. Esasen doğrudan demokrasilerin bir aracı olan referanduma onu ödünç alan, bu çalışmanın da örnek vakaları olan Türkiye ve Şili gibi temsilî demokrasilerde de sıklıkla yer verilmektedir. Bu çalışmada özel olarak Anayasa referandumlarıyla ilgilenilmektedir ve bu referandumlar “demokratik meşruiyet” kavramının gerekleri çerçevesinde ele alınmaktadır. 

Bu makalede referandum yönteminin demokratik meşruiyet kavramı üzerinden ele alınması bir tesadüf değildir. Gerek Türkiye, gerekse dünya siyasi tarihi temel alınarak denilebilir ki, demokratik meşruiyet her siyasi akım ve harekette, toplumu ilgilendiren her tür reform veya devrimde, hem gerçekleştirenler açısından hem de sonuçtan etkilenenler açısından göz ardı edilemez bir değişken olmuştur. Demokratik meşruiyetin, yöneten ve yönetilen arasındaki ilişkinin en önemli öğelerinden biri olduğu söylenebilir. 

Altı çizilmelidir ki demokrasi pratiğine katkısı yadsınamaz olan referandumun, aynı zamanda “demokratik” olarak nitelendirilebilmesi ve meşruiyetinin sorgulanmaması için, hazırlanma ve gerçekleşme süreçlerinde kimi kriterleri yerine getirmesi şarttır.

The democratic legitimacy criteria of constitutional referendums: Turkey and Chile experiences

Referendum has become a method which is applied increasingly as a political participation device in today’s democracies. Referendum, which is essentially one of the voting means of direct democracies, is also frequently used in large numbers of representative democracies such as Turkey and Chili who are case studies of this article. Hereby with this study, concentrated specially on constitutional referendum concept, referendum is addressed within the framework of requirements of “democratic legitimacy” notion.

Considering referendum method on the basis of the concept of democratic legitimacy is not a coincidence. Based on both political history of Turkey and the world, it can be said that legitimacy has been a non-negligible variable for both the executers and the ones who are affected by the result in all political trends and movements, and every kind of reform or revolution concerning the society. Legitimacy is one of the most significant elements of the relationship between the governors and the people governed.

Referendum, contribution of which to the practice of democracy is undeniable, cannot be inherently characterized as “democratic”; it should meet some criteria both in preparation and realization processes. As a result, its democratic legitimacy is not questioned.
